Terms of Service for the FaktuPro Application


1. General Provisions

1.1. These Terms of Service set out the rules for using the FaktuPro application (hereinafter: "Application", "Service") available on the macOS platform via the Apple App Store.

1.2. The Application is a tool that supports the issuance of financial documents and integration with the Polish National e-Invoice System (KSeF).

1.3. Using the Application constitutes acceptance of these Terms of Service and the Privacy Policy.

1.4. These Terms supplement the Apple Standard End User License Agreement (Apple EULA). With respect to distribution through the App Store, Apple's terms take precedence.

1.5. To the extent required by Apple's terms, Apple may enforce the rights arising from the relevant provisions regarding the use of the Application.

1.6. The Service is intended exclusively for adults conducting business activities or acting on behalf of business entities.

1.7. Service Provider:

(hereinafter: "Provider")


2. Definitions

  • User — a natural person conducting business activity or representing a business entity who uses the Application
  • Account — the User's individual account in the Application
  • Vendor — the User's company profile in the Application
  • Plan — a usage tier for the Application (e.g., free or paid plan)
  • KSeF — the Polish National e-Invoice System operated by the Ministry of Finance of the Republic of Poland

3. Registration and Account

3.1. Using the Application requires creating an Account by providing an email address and password or using Apple Sign In.

3.2. The User agrees to:

  • provide truthful information,
  • maintain the confidentiality of login credentials,
  • immediately notify the Provider of any unauthorized access to the account.

3.3. One Account corresponds to one Vendor profile.

3.4. The User is responsible for all actions performed using their Account.


4. Plans and Payments

4.1. The Application offers various usage plans, including a free plan and paid subscription plans.

4.2. The scope of features for each plan is presented in the Application and in the Apple App Store.

4.3. Payments are processed exclusively through the Apple App Store (In-App Purchase).

4.4. Subscriptions renew automatically in accordance with Apple's terms, unless cancelled by the User.

4.5. Subscription cancellation is done through Apple ID account settings.

4.6. The Provider does not store credit card data — payments are handled by Apple.

4.7. Price Changes

4.7.1. The Provider may change plan prices, introduce promotions, and time-limited offers.

4.7.2. Price changes do not affect an already paid subscription period.

4.7.3. For auto-renewing subscriptions, price changes are applied in accordance with Apple App Store policies, including User notification requirements.


5. Smart Invoice (AI)

5.1. The Application may use artificial intelligence solutions to assist in creating documents.

5.2. Results generated by AI are advisory in nature.

5.3. The User is obligated to verify all generated content before use.

5.4. The Provider is not liable for consequences resulting from the use of AI-generated content.


6. KSeF

6.1. The Application enables submitting documents to KSeF and downloading them.

6.2. The User is solely responsible for:

  • the accuracy of data,
  • possessing and protecting access to KSeF,
  • compliance of actions with the law.

6.3. The Provider is not liable for:

  • unavailability of KSeF,
  • errors resulting from the operation of external systems.

7. Documents and Data Responsibility

7.1. The Application is a tool that supports the issuance and management of financial documents.

7.2. The User is solely responsible for:

  • the correctness of data,
  • compliance of documents with the law,
  • the manner in which documents are used.

7.3. Document Storage

7.3.1. The User is solely responsible for storing accounting and tax documents for the period required by law.

7.3.2. The Application does not constitute a guaranteed long-term document archive service.

7.3.3. The Provider may store data only for the period of:

  • providing the Service,
  • fulfilling legal obligations,
  • pursuing or defending claims.

7.3.4. The User should independently create backups of their data.


8. Document Numbering

8.1. The Application supports maintaining document numbering continuity by:

  • allowing deletion of only the last document,
  • automatically suggesting the next number.

8.2. The User may manually change a document number.

8.3. Manual changes to numbering may result in a break in numbering continuity.

8.4. The User bears full responsibility for correct document numbering.

8.5. The Provider is not liable for consequences of incorrect numbering resulting from the User's actions.


9. Account Deletion

9.1. The User may delete their Account at any time.

9.2. Account deletion results in the deletion or anonymization of data, except for data that must be retained:

  • pursuant to legal requirements,
  • for the purpose of pursuing or defending claims.

9.3. Account deletion is irreversible.

9.4. Account deletion does not automatically cancel the Apple subscription. The User is responsible for cancelling the subscription independently through Apple ID account settings. The Provider is unable to cancel subscriptions on behalf of the User and is not liable for charges incurred by Apple in the event that the subscription is not cancelled.


10. Liability

10.1. The Application is provided in its current form and scope of functionality.

10.2. The Provider is not liable for:

  • errors in data entered by the User,
  • consequences of using the Application in business,
  • unavailability of external systems,
  • actions of AI,
  • data loss resulting from the actions of the User or third parties,
  • lost profits, revenue, clients, administrative or tax penalties.

10.3. Limitation of Liability

To the maximum extent permitted by law, the Provider's liability to the User is limited to the amount of the fee paid for the last completed billing period.

10.4. Exclusions

Limitations of liability do not apply to damages caused intentionally.


11. Suspension and Termination of Service

11.1. The Provider may suspend or delete the User's account in the event of a violation of these Terms.

11.2. The Provider may terminate the Service or part thereof for important reasons, in particular:

  • discontinuation of product development,
  • technological changes,
  • legal changes,
  • business decisions.

11.3. The User will be notified of Service termination:

  • via a notification in the Application or by email,
  • with appropriate advance notice, where possible.

11.4. Where possible, the Provider will enable the User to download their data before the Service is terminated.


12. Complaints

12.1. The User may file a complaint regarding the operation of the Application.

12.2. Complaints may be filed electronically at the Provider's email address or via the in-app form.

12.3. A complaint should include a description of the issue.

12.4. Complaints are processed within 14 days.


13. Intellectual Property

13.1. The Application is the intellectual property of the Provider.

13.2. The User retains rights to their data.

13.3. The User may not copy, decompile, or interfere with the operation of the Application, except in cases expressly permitted by mandatory provisions of law.


14. Technical Requirements

14.1. The following are required to use the Application:

  • a device running macOS,
  • an internet connection,
  • an Apple ID account.

15. Data Processing

15.1. User data is processed in accordance with the Privacy Policy.


16. Changes to the Terms

16.1. The Provider may amend these Terms.

16.2. The User will be notified of material changes in advance.

16.3. Continued use of the Application constitutes acceptance of the changes.


17. Final Provisions

17.1. These Terms are governed by Polish law.

17.2. If any provision is found to be invalid, the remaining provisions shall remain in force.
